英国议会通过《2008年刑事司法与移民法》有一个重要的内容,就是改革了现行青少年司法制度,强化了审判前处罚,整合了现行社区刑罚,并细化了各类处罚的适用条件。它对英国青少年司法体制产生了重大的影响。通过对《刑事司法与移民法》涉及青少年司法内容的详细解说,启示我们我国的未成年人司法制度应在吸收国外优秀制度和立足于本国国情基础上,从尽快建立合理完备的未成年人司法体制、适当扩大非监禁刑罚措施、增设非刑罚的处理措施、司法中兼顾量刑的统一这四个方面加以完善。
